_Zoning Changes Released for Business and Industrial Land

Proposed zoning changes to individual Local Environmental Plans (LEPs) at a site-specific level have now been released for the majority of Council LEPs.

In December 2021, the NSW Government released details of proposed new zones to replace existing Business and Industrial zones across NSW. This is part of a series of reforms to simplify the planning system, and support business productivity and jobs growth.

Proposed zoning changes to individual Local Environmental Plans (LEPs) at a site-specific level have now been released for the majority of Council LEPs. This includes:

  • Three [business] centres-focused zones and two industrial zones (down from 12 currently)
  • Three supporting zones that capture land uses and locations that have a focus beyond jobs (mixed uses, enterprise, and waterways)
  • A clear strategic intent for each zone that builds on strategic work by the State and councils over the past five years.

The new employment zones will be in place by 1 December 2022, and the current Business and Industrial zones within individual LEPs will be repealed.

It is important for landowners to be familiar with the potential benefits or implications that the new zones could have on local land use permissibility. For example, the expansion permissibility of industrial uses resulting from the consolidation of the IN1 General Industrial and IN2 Light Industrial zones into a new combined General Industrial zone (E4).

Feedback is invited until 12 July 2022. This is an important opportunity to provide feedback on the proposed changes to individual LEPs.
